Tony needs names asap to add to the "class action" court challenge in two categories: 1. 12(6) prohibited handguns acquired between 1995 and 1998. There of thousands of us who acquired prohibited handguns in this time period. The CFC claims there are only a few hundred. Originally the amendments to the Regulations would have both allowed us to keep our 12(6) prohibs and to be "grandfathered" to acquire more. Now, because the CFC did not re-register our handguns after we applied for re-registration, we may not possess these firearms. This is clearly unfair, and will be challenged in court. 2. Those who possess certain categories of prohibited firearms have received notice that they cannot be taken to the range. The Supreme Court of Canada says two Manitoba men should be retried on charges of impaired driving. Both were acquitted because police officers did not fully inform them of their rights before they agreed to - and failed - roadside sobriety tests. The court says such rights are reasonably limited in cases where police are trying to keep drunks off the road. The court said this is true even in provinces that have not specifically laid out such limits in law. Just yesterday, Ontario Court Justice Robert Weseloh was bemoaning the fact that criminals didn't seem to be getting the point that committing crimes with guns won't be tolerated - before imposing a measly 1 year sentence. Some deterrent! In this latest case, John Read, a four time loser, who was already prohibited for life from possessing firearms, was sentenced to a paltry 2 1/2 year term for breaking and entering, theft, and using a firearm in the commission of a crime. Let's take a look at the possible sentences for each of these crimes: Armed robbery with a firearm: minimum sentence FOUR YEARS; maximum sentence LIFE IN PRISON! Break and Enter a dwelling place: maximum sentence, LIFE IN PRISON! Weapon dangerous: maximum sentence TEN YEARS! Pointing a firearm: maximum sentence FIVE YEARS! Unregistered firearm: maximum sentence FIVE YEARS! Loaded firearm: maximum sentence TEN YEARS! Stolen firearm: maximum sentence TEN YEARS! Two and half years for crimes committing several crimes, some of which carry a possible life sentence, isn't a "strong message" in my books. When will the Courts learn that unless and until they start imposing meaningful sentences as punishments for these kinds of crimes, the criminals simply continue to break them with impunity? On Wednesday, Andrew Benjamin Cook, 24, of 504 Tree Top Street, Virginia Beach, Va. and Adria Joy Hinkle, 27, of 1602 Claremont Ave., Norfolk, Va. were each charged with 31 felony counts of animal cruelty and eight misdemeanor counts each of illegal disposal of dead animals. Both were transported to the Hertford County jail, each under a $35,500 secured bond. Ahoskie Police Chief Troy Fitzhugh said Cook and Hinkle posted bond prior to incarceration. "We've been investigating animal cruelty and illegal disposal of dead animals within our city for the last four weeks," Fitzhugh said. "Our investigators determined that these incidents were occurring every Wednesday for approximately one month." Yesterday (Wednesday) law enforcement officials with the Ahoskie Police and Bertie County Sheriff's Office were able to observe a white panel van drive next to the commercial dumpster located behind Piggly Wiggly in Newmarket Shopping Center. A person in the van tossed several dark-colored bags in the dumpster before the van attempted to pull away. At that time, a traffic stop was initiated on the van - a vehicle occupied by Cook and Hinkle. The bags located in the dumpster contained 18 dead dogs, including one bag containing seven puppies. An additional 13 dead dogs were found in the van. A license check revealed the van was registered to PETA in Norfolk, Va. It is not yet confirmed if Cook and Hinkle are official representatives of the animal rights group. However, Detective Sgt. Ed Pittman of the Bertie Sheriff's Office confirmed, through the county's Animal Control Officer, that Cook and Hinkle identified themselves as PETA representatives from Norfolk, Va. "According to Barry (Anderson, Bertie's Animal Officer), the man and woman told him they were picking up the dogs to take them back to Norfolk where they would find them good homes," Pittman said. Pittman added that as far as he knew, persons identifying themselves as PETA representatives had picked-up live dogs at the Bertie Animal Shelter for at least the last two months. Anderson, also involved in Wednesday's surveillance and subsequent arrest, was able to positively identify nearly all of the dogs found in the dumpster as the ones picked-up just a few hours earlier on Wednesday by Cook and Hinkle. "Barry documents the animals as they are received at the animal shelter," Pittman noted. Two of the 31 dogs were kept for an autopsy. The remainder were properly buried on Town of Ahoskie property. Chief Fitzhugh praised the work of his lead investigator, Detective Sgt. That makes eminently good sense. So do many other recommendations in Borderline Insecure, an interim report by the Senate Committee on National Security and Defence released this week. A recommendation that will fly well with Canadians is that within five years, the ceiling in goods that will be allowed into Canada from the U.S. for those outside the country for at least a week be raised from $750 to $2,000. It's not that the committee wants Canadians to shop in the U.S. Rather, consigning inspectors to the role of tax collectors at the border "takes up an inordinate amount of their time." All of this detracts from security, which should be their primary function, especially post-9/11. And why not? What is there to lose? How many people will spend more than $2,000 anyway, particularly since the gap between the two currencies has narrowed dramatically? Besides, says the committee, the amount of tax collected is not that significant. The staffing -- or lack of it -- at some crossings is another wake-up call. There are 139 ports of entry across Canada where border personnel work alone at least part of the time. The committee wants all shifts at land border crossings staffed by at least two persons by Dec. 31, 2007. The stakes couldn't be higher, the report notes. "Serious damage to major land border crossings between Canada and the United States would have a profound impact on the Canadian economy, over and beyond the physical casualties such an incident would be likely to produce," the senators wrote. If understaffing isn't frightening enough, our border personnel are not armed. Since prompt police protection is unlikely, guards should be trained and equipped with firearms. While that prospect may be unsettling to many Canadians, staff should not be defenceless in harm's way. "The committee has reluctantly come to the conclusion that if the federal government is not willing or able to provide a constant police presence at Canada's border crossings, current border inspectors must be given the option of carrying firearms," the report says. The Senate committee response is not one of paranoia. It is one of reality.
