Offences related to Sale, Delivery or Acquisition of Firearms and other Offensive Weapons Transfer of firearm to person under 16 - Saving provision 93. (1) Every one who gives, lends, transfers or delivers any firearm to a person under the age of sixteen years who is not the holder of a permit under which he may lawfully possess the firearm [1991, c.40, s8(1) will repeal subsection 93(1) and substitute the following (proclaimed to be in force January 1, 1995).] 93. (1) Every one who gives, lends, transfers or delivers any firearm to a person under the age of eighteen years who is not the holder of a permit under which the person may lawfully possess the firearm (a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding two years; or (b) is guilty of an offence punishable on summary conviction. (2) Subsection (1) does not apply to a person lawfully in possession of a firearm who permits a person under the age of sixteen years to use the firearm under his immediate supervision in the same manner in which he may lawfully use it. [1991, c.40, s.8(2) will repeal subsection 93(2) and substitute the following.] (2) Subsection (1) does not apply to a person lawfully in possession of a firearm who permits a person under the age of eighteen years to use the firearm under his immediate supervision in the same manner in which that person may lawfully use it.
