Pointing a Firearm - Careless use, etc., of Firearm - Storage, etc. of Firearm. 86. (1) Every one who, without lawful excuse, points a firearm at another person, whether the firearm is loaded or unloaded, (a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding five years; or (b) is guilty of an offence punishable on summary conviction. (2) Every one who, without lawful excuse, uses, carries, handles, ships or stores any firearm or ammunition in a careless manner or without reasonable precautions for the safety of other persons (a) is guilty of an indictable offence and liable to imprisonment (i) in the case of a first offence, for a term not exceeding two years, and (ii) in the case of a second or subsequent offence, for a term not exceeding five years; or (b) is guilty of an offence punishable on summary conviction. [1991, c. 40, s. 3 will repeal subsection 86(2) and substitute the following.] (2) Every person who uses, carries, handles, ships or stores any firearm or ammunition in a manner that shows wanton or reckless disregard for the lives or safety of other persons (a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding five years; or (b) is guilty of an offence punishable on summary conviction. (3) Every person who stores, displays, handles or transports any firearm in a manner contrary to a regulation made under paragraph 116(1)(g) (a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding two years; or (b) is guilty of an offence punishable on summary conviction. 1991, c. 40, s. 3
